This law provided for strict age controls for Streaming porn on the Internet, or block platforms, if this is not introduced. This is the thrust of the government was therefore also referred to as a Porn Block. In the meantime, there were even discussions about the fact that the government could adopt the necessary network lock arbitrary.

The EU Commission was not informed

The Porn-Blockade but also caused, in addition, for many discussions and difficulties in the possible interpretation and implementation. This was delayed again and again. Recently, the government had moved to the part of the law in the summer of this year for an indefinite period of time. The government had failed simply, the EU Commission about the plans to teach, but this is to be mandatory.

In addition to age verification, the plans were at the beginning of the censorship of certain “non-conventional” sexual practices. The competent authority weakened, the prohibition of porn distribution with a certain content at the beginning of this year, however, significantly. This is regardless of the issues, blockages and the age verification also apply in the future.

The civil rights organisation the Open Rights Group criticized the law plans again and again. As would be recognized, only those companies that pornographic content on a commercial Basis provide, but not to Social Media platforms. Similarly, the proposed network could lock probably easily handle it.

The organization, described the law as a “meaningless, misleading and potentially dangerous”. She is now cautious pleased with the preliminary the end of the plans. Further, it is to say but: “however, It is still unclear what the government intends, and we will remain vigilant to ensure that new proposals are just as bad or worse”. A real improvement of the Situation is, at least currently, but not foreseeable.

The new law, plans with a known content

Nevertheless, the goals of the original act, implementing the protection of children from pornographic content – the government in the future on a Online Harms regulation. This provides for a duty of care for companies that require measures to improve the Online-to implement security. An independent Supervisory authority should review this measure.

The plans of the Online Harms regulation include previously illiegale content, depictions of violence or terrorism, and are currently still in the Phase before the actual legislative process. In a detailed White Paper, the government has presented their plans, and makes this clear even in the current government Declaration.

There it is, the government wants to continue to rely on security technologies. This “includes tools for age verification and we expect that this will continue to play a key role in the protection of children on the Internet”. The introduction of the system for Online porn seems to be only provisionally suspended and will be implemented apparently, a more far-reaching legislation.

Independent Control Authority

The previously available plans to the Online-Harms-legislative implementation in the hands of the operators of the platforms and independent of the government control authority. This should be allowed to impose penalties, including fines.

In addition, it is stated in the White Paper: “We can advise about powers that would enable the regulatory authority to interfere with the business activities of a non-compliant company, as well as measures for the imposition of liability for individual members of the Executive Committee and measures for the blocking of non-compliant tenders”. The possibility of grid-lock seems to be also further provided.

One of the UK government in 2013 introduced a mandatory porn filter has been declared in 2015 of the EU-Commission to be illegal. In response, the government announced that it plans to want to the filter systems to hold. As the current government policy and the work on the Online-Harms-show package, nothing has changed since then, in principle, to the Position of the government in the United Kingdom.
